IMMACULATE CONCEPTION BULLETIN
June 29, 1997
FRIARS' MIND
The sentence of death for Timothy McVeigh has prompted many
to ask what the Catholic church teaches regarding capital
punishment.
Capital punishment is a life issue, but one must
distinguish this from the morality of other life issues such
as abortion. Abortion, the direct taking of an innocent,
defenseless human life is intrinsically evil. No one has
the right to perform an abortion. The state does have the
right to employ capital punishment to defend the good of
society. But this is not an unqualified right.
The Catechism of the Catholic church states that
"legitimate public authority has the right to punish
malefactors with penalties commensurate with the gravity of
the crime, not excluding, in cases of extreme gravity, the
death penalty. If bloodless means are sufficient, public
authority should limit itself to such means because they are
more in conformity with the dignity of the human person."
In his 1995 encyclical "Evangelium Vitae" (The Gospel of
Life) Pope John Paul II wrote: "The nature an extent of the
punishment must be carefully evaluated and decided upon, and
ought not go to the extreme of executing the offender except
in cases of absolute necessity. In other words, when it
would not be possible otherwise to defend society. Today,
however, with the organization of the modern penal system,
such cases are very rare if not practically nonexistent."
(No. 56)
What are the rare cases that the encyclical has in mind?
Catholic moralist would suggest the anarchy in some third
world countries resulting, for example, in the horrors of
the tribal attacks in Rwanda.
Some have asked, "If the terrible crime of McVeigh is not
justification for the death penalty, then what is?" That is
not the precise question. The issue is not simply the
gravity of the crime, deterrence, "justice" and certainly
not revenge. The question is, "Can society be adequately
protected by imprisoning McVeigh for life rather than by
executing him?"
Finally our Catholic Bishops have asked us to consider
what capital punishment does to us as a society not simply
what it does to the criminal. Does killing the person who
killed, teach society that killing is wrong, or does it only
perpetuate a terrible cycle of violence and further diminish
respect for human life?
